1.  When are the most divorce cases filed?

While many dread the muggy discomfort of August, for some, it carries a particular sting. August, along with the February/March period, witnesses a surge in divorce filings. Unhappily married couples often strategically time their divorce proceedings to avoid disrupting holiday seasons (like Christmas) and Valentine's Day, as well as peak summer vacation months (July being the most popular). This timing likely reflects a desire to minimize disruption and emotional distress, especially when children are involved, during these significant family-oriented periods.

2.  Which divorcing spouse is your target client?

In the divorce market, a key target client for real estate agents is the 'stay spouse' – the spouse who intends to remain in the marital home after the divorce.

However, it's crucial to advise stay spouses that accepting the house in a divorce settlement can present significant financial risks.

Here's a common scenario:

The 'out spouse' may agree to relinquish their claim to the house in exchange for retaining valuable assets like a pension.  If the stay spouse cannot qualify for a mortgage refinance (due to insufficient income, credit score, or other factors), Foreclosure can become a serious possibility.

Importantly, since both spouses are typically co-borrowers on the mortgage, even the out spouse may be unable to obtain a new loan, leaving both parties facing severe financial consequences.

As a real estate agent, you can play a vital role by:

Educating stay spouses about these potential risks and connecting them with financial advisors, mortgage professionals and divorce attorneys.  Helping divorcing couples explore alternative solutions, such as: buying out the out spouse's equity by refinancing the mortgage with only the stay spouse as the borrower (if possible).  And if that strategy does not work, then help the divorcing couple sell the property and then dividing the proceeds. 

This course will educate  you on the risks involved for both parties and you can help guide your clients to the correct professional to help them make informed decisions.
